Help Me Fake Gibson Guitar?

I bought a 100% percent fake Gibson for $1609. Yeah I know, stupid on my part huge. I am going to the dude tomorrow and ask him to give me my money back. I think its illegal to sell fake Gibsons, cause they are trademarked. If he don't give me my money, ill probably take court action and get my money. I know him on a personal level, cause i've been taking lessons from him going of seven months. I'll explain as much as possible but I want my money. It was gave to me as a present form my parents and grand parents. They started crying when I opened the case and saw what was inside. I did some stuff looking for guitars a couple months ago and somehow led me to fake gibsons. What should I do if I don't get my money back? Should I take him to court?What do I do? Help me. I'm so confused.
